A Temple man, identified as 40-year-old Jimmy Dewayne Towe Jr., was arrested in Cedartown this week after deputies were dispatched to the Polk County 911 dispatch center regarding a report of a man urinating outside the building.

Upon arrival, an officer found Towe outside the facility. According to the incident report, the officer immediately noticed the smell of alcohol on Towe, along with bloodshot eyes and difficulty speaking without interruption. Towe reportedly told the officer he had been driving from Temple and became lost while looking for an address in Armuchee, stopping at the property to use the bathroom. He also stated he had consumed more than a pint of alcohol in the preceding hours.

Towe agreed to perform Standardized Field Sobriety Testing. During the Horizontal Gaze Nystagmus test, he displayed six out of six clues indicating impairment. Towe declined to attempt the walk-and-turn test due to reported hip issues.

He then consented to a breathalyzer test, which registered a blood alcohol concentration of 0.209, more than twice the legal limit. Towe was placed under arrest and agreed to a blood draw under implied consent.

The 911 director later provided video evidence showing Towe driving into the parking lot shortly before 8:55 p.m., stumbling through the yard, and urinating on a power pole near the entrance. The footage was captured on both dispatch center cameras and the responding officer’s body-worn camera.

Before the vehicle was towed, officers observed an open container in the front cup holder containing a clear liquid that smelled of alcohol. During transport to the Polk County Jail, Towe reportedly stated that the charges would not “stick” because he had already parked before officers arrived and believed he had consumed too much alcohol to continue driving.
