Floyd County Judge William Sparks sentenced David Wayne Huether, 63 of Lindale, to 30 years in prison and life of probation after being convicted of sexually abusing a mentally disabled child back in 2018.

Despite being arrested in 2019, the case was postponed pending a psychiatric evaluation.  However, Huether, who has been out on bond, refused to work with state mental health officials.

Huether remained steadfast claiming his innocence during sentencing this week.

David Wayne Huether, 58 of Lindale, was arrested this week after reports said he sexually assaulted a man with “diminished mental capacity”.

Reports said that Huether grabbed the victim’s penis and forced him to submit to acts of oral and anal sexual relation.

The incident occurred at a home on Spring Street in Lindale back on September 1 of last year.

Huether is charged with sexual battery, sodomy, and exploitation and intimidation of an elderly or disabled person.
