Brian Lee Kyle, 27 of Rome, was arrested this week after reports said he stole a shovel from Checker’s restaurant on North Broad Street.
Police said that after Kyle took the shovel, without permission, he proceeded to threaten a witness before throwing it on the ground and running from the scene.
Kyle is charged with theft by taking.
