A licensed notary, David Allen Berman, 57 of Acworth, was jailed in Rome after he illegally notarized a document giving another man power of attorney over another’s bank account at the Etowah Landing Nursing Home.

Reports said that Berman admitted to not bien present when the document was signed, nor did he witness the signature that resulted in Russell Eugene Smith (story below) stealing over $25,000 from a dementia patient at the nursing home.

Berman is charged with felony theft by deception, exploitation of the elderly and violation of performing notarial services.

Russell Eugene Smith, 52 of Dallas, was arrested this week after reports said he portrayed himself as a lawyer and attorney during a series of meetings with dementia patients at Etowah Landing Nursing Home.

Police added that Smith proceeded to obtain over $25,000 from a woman who suffers from dementia by getting her to sign power of attorney over to him in order to gain her funds.

Smith is charged with felony theft by deception, impersonating another, and exploitation of an elderly or disabled person.
