Justin Heath Sweeney, 41 of Guntersville, AL, was arrested in Rome after he was observed kicking a small child on Broad Street.
Reports said that the child suffered visible injuries to his leg.
He was later found to be driving under the influence of alcohol with the child in the car.
Sweeney is charged with cruelty to children in the 1st degree, DUI and endangering a child by DUI.
