Attorneys for Stephano Tyrique Green, 22 of Rome, have filed a motion for a new trial after being sentenced to life plus five years in prison for the murder of Derricus Whatley.

Green was convicted and sentenced for murder but acquitted on a malice murder charge.

Green has maintained his innocence but did declined to speak at the sentencing hearing.

His attorney’s said, “The trial in this case denied (Green) the fundamental fairness guaranteed to him by the United States Constitution and the Constitution of the State of Georgia.”

Stephano Tyrique Green, 20 of Rome, turned himself into the Floyd County Jail after being sought-after since early July for the murder of Derricus Whatley.

Green is charged with felony murder.

On Sunday, July 3 at about 5:50 pm Rome/Floyd 911 received a call of a vehicle accident with injury on Tolbert Street. Other calls received advised the driver has been shot. Upon officers arrival they found the victim with a gunshot wound. Officers began rendering first aid until emergency medical personnel arrived. The victim was transported to the hospital where he was pronounced deceased. The victim is identified as Derricus Whatley, 40 years old with a Rome address.

Rome Police Criminal Investigators assumed control of the scene and investigation.

An arrest warrant for the suspect, 20 year old Stephano Green has been issued. He has not been located at this time.
