Judge Harold L. Murphy has ruled to dismiss portions of a lawsuit filed by current and former athletes at Shorter University. The lawsuit was filed earlier this year after person information was stolen from an unlocked room at the school. Murphy ruled to dismiss claims for breach of contract and negligent misrepresentation, but did allow negligence and breach of fiduciary duty to remain.

The suit was brought forth by former cheerleader at the school, Erin Bishop, who said that she learned that her information was stolen when she went to fill out her tax return. She stated that she was informed that someone using her social security number had already filed a return and got her tax refund.

Ten others joined her suit later. Approximately 900 former athletes had their files with personal and some medical information stolen.

No arrest has been made.
